Membership Terms

Welcome to your Blowbar Membership! These terms and conditions (“Membership Terms”) form the agreement between you (hereinafter “You” or the “Member”) and Blowbar, LLC (“Blowbar”) with respect to your subscription and use of the “Hello Gorgeous”, “You Glow Girl” or “Drytini” memberships (each a “Membership”). By subscribing to a Membership or using the services/discounts included within the selected Membership (hereinafter the “Membership Services”), you agree to (1) these Membership Terms, (2) Blowbar’s Privacy Policy, and (3) our payment processor’s Privacy Policy [https://terms.fresha.com/privacy-policy]. Together, these are the “Terms.”

Please read these Membership Terms carefully. If you don’t understand them, or don’t accept any part of them, then you may not subscribe to any Membership or use the Membership Services. You must be 18 years or older to be a Member.

Blowbar reserves the right to change these Membership Terms, including pricing, benefits, and policies, at any time. Members will be notified of such changes via email or by posting an updated version of these Membership Terms on Blowbar’s website. Continued use of Membership Services after any such changes constitutes acceptance of the revised terms. Blowbar may also terminate a Membership at any time, for any reason, without prior written notice.

Blowbar Memberships:

You may choose from three Membership options. Upon registration as a Member at Blowbar, you will be entitled to all rights and privileges associated with your selected Membership, which will commence immediately.

1.         “Hello Gorgeous” Membership: When you subscribe to the “Hello Gorgeous” Membership, you agree to pay a monthly fee of $66.00 plus IVU (total $73.59). For clients with hair extensions, the monthly fee is $100.00 plus IVU (total $111.50). Each monthly fee entitles the Member to two (2) basic services, each consisting of a hair wash and blowout with style, a twenty-five percent (25%) discount on salon product purchases at Blowbar and $3.00 off on any additional salon service, each membership month. The salon product discount excludes jewelry, merchandise, bags, and pop-up items

2.         “You Glow Girl” Membership: When you subscribe to the “You Glow Girl” Membership, you agree to pay a monthly fee of $116.00 plus IVU (total $129.34), or $188.00 plus IVU (total $209.62) for clients with hair extensions. Each monthly fee entitles the Member, during each Membership month, to four (4) basic services (each consisting of a hair wash and blowout with style), a twenty-five percent (25%) discount on salon product purchases at Blowbar (excluding jewelry, merchandise, bags, and pop-up items), a $3.00 discount on any additional salon service, a $5.00 discount on any additional blowouts, and one (1) complimentary birthday blowout. “Additional salon services” include, but are not limited to, hair masks, hair shots, braids, updos (“Uptown Girl”), Drytini (a salon service, not the separate membership), and scalp massage (“Root Beer”), and exclude makeup services. The complimentary birthday blowout must be redeemed during the billing cycle in which the Member’s birthday occurs.

3. “Drytini” Membership: When you subscribe as a Member of the “Drytini” Membership you agree to pay a monthly fee of $80.00 plus IVU ($89.20). For clients with hair extensions the “Drytini” Membership price is $120 plus IVU ($133.80). This monthly fee entitles Member to four (4) dry services to choose between waves, curls or straight and a twenty five percent (25%) discount on salon products. Salon product discount excludes jewelry, merchandise, bags or pop ups. Blow drying the hair is not included in this Membership. All services offered under this Membership are to be provided exclusively on dry hair. If a client arrives to their Membership Service appointment with wet hair, full regular service price will be charged.

Membership Terms:

Payment. At this time, Blowbar only accepts payments via credit card or VISA Debit cards. When subscribing to any of the Blowbar Memberships, Member agrees to abide by any relevant third-party terms and conditions that may govern the use of this particular payment method, including but not limited to those imposed by his/her credit card. Each Member agrees and understands that the Member's credit card will automatically be charged the applicable recurrent monthly fee. It is each Member's responsibility to keep Blowbar informed of accurate billing information. A new form must be completed for any changes in billing information. Any changes to payment details must be done at least 72 hours before any payment is due. The monthly fee will be charged automatically each month on the same day of the original subscription to the Membership. The membership fees will recur monthly until cancelled by the Member or suspended by Blowbar. Subscription fees paid are final and nonrefundable, unless otherwise determined by Blowbar. Blowbar will automatically add a 3% processing fee to all declined charges and may suspend Membership immediately if payment cannot be processed. Memberships cannot be paused, suspended, or “frozen” for any reason, including vacation, travel, illness, or inability to attend appointments.

Unused Membership Services. Member is not entitled to redeem unused Membership Services or discounts for cash or store credit and Member is not entitled to a refund for any unused Membership Services or discounts at any time during Membership or upon cancellation. Membership Services must be used within the applicable month. Unused monthly Membership Services cannot be transferred to, or accumulated for, subsequent months. If Blowbar terminates the Membership, the Member's credit card will not be charged for the next billing period and the terms applicable to canceled memberships will apply.

Transferability. Membership Services are non-transferable and can only be used by the Member. Any attempt to transfer benefits under the Membership may result in automatic cancellation of Membership.

Membership Services Redemption. Members have thirty (30) days to redeem Membership Services in each billing period. To redeem Membership Services, Members must provide their name and identify themselves as a Blowbar Member prior to receiving the Membership Service or purchasing a product by using a Membership discount. Blowbar reserves the right to request proper identification from a Member before providing Membership Services. Membership discounts cannot be combined with other offers.

Hair Extensions. As stated in these Membership Terms, Blowbar offers a regular price for each Membership, and a specific Membership price for those clients with hair extensions. If a client with hair extensions opts for registering under the regular price of a Membership or if the client puts hair extensions after enrolling to one of our regular Memberships, he/she will have to request Blowbar to modify their Membership in order to include the price for hair extensions, or he/she will be charged an additional $11.00 per each service received. This additional amount is intended to cover the cost of providing high quality service for clients with hair extensions and is exclusive to clients who fall under this category. By enrolling in a regular Membership and also having hair extensions, client acknowledges and agrees to the additional charge of $11.00 for each service. Clients with hair extensions are responsible for informing our stylists about their hair extensions’ origin and type. This information will enable our stylists to take additional precautions during the service. However, Blowbar will not be liable, and client assumes all responsibility for any damage to hair extensions during or after the provided services.

Cancellations, No-Shows, and Late Arrivals. You may cancel your Membership at any time before the end of the current billing period and the cancellation will take effect on the next billing period, except as otherwise communicated to you by Blowbar. CANCELLATIONS MADE WITHIN THREE MONTHS OF REGISTRATION WILL HAVE A CANCELLATION FEE OF $50.00. You will retain access to the Membership Services from the month in which you cancelled your Membership subscription, until the start of the next billing period. You will not receive a refund or credit for any remaining or unused Membership Services in your current billing period. To cancel your Membership, you may do so at any time directly through your Fresha account, by calling us at (787) 995-7705, or by visiting us in person and requesting cancellation at the reception desk. All cancellations will take effect prospectively and will not be applied retroactively; charges already processed will not be refunded, and cancellation will only apply to future billing periods.

Appointment cancellations made less than two (2) hours before the scheduled appointment, or failure to show up for an appointment, will result in a charge equal to thirty percent (30%) of the regular service price (not the Membership price), which will be charged automatically to the card on file. If you arrive more than fifteen (15) minutes late, your appointment will be cancelled, and the late cancellation fee will apply. Members may book recurring appointments (e.g., every Monday at 7:00 a.m., subject to availability); however, if you cancel three (3) consecutive recurring appointments, regardless of whether such cancellations are made within the required notice period or not, all future recurring reservations will be cancelled and must be rebooked subject to availability.

Any person who cancels their Membership and later re-enrolls will be subject to the Membership Terms in effect at the time of re-enrollment.

 Indemnity: Blowbar will not be liable for: Member’s use of the Membership Services, his/her inability or incapacity (for whatever reason, including without limitation, ill or unfit health) to use the Membership Services. Member agrees that he/she is fully aware of any and all risks and hazards associated with the use of the Membership Services. To the fullest extent permitted by law, Member hereby releases, hold harmless, and forever discharges Blowbar, and each of its employees and agents, from any and all liability in relation to the Membership or the Membership Services.   Blowbar will not be liable for any direct, indirect or consequential loss or damage incurred by a Member in connection with the Membership or the Membership Services, including, without limitation, any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. 

Force Majeure: Company shall not be liable for failure to provide or delay of services resulting from acts of God or other causes beyond Blowbar’s control. 

Severability: In the event any provision of these Membership Terms is determined to be invalid by a court of competent jurisdiction, such determination shall in no way affect the validity or enforceability of any other provision herein. 

Waiver:  Blowbar’s failure in any one or more instances to insist upon strict performance of any of the Membership Terms or to exercise any right herein conferred shall not be construed as a waiver or relinquishment of that right or of Blowbar’s right to assert or rely upon the Membership Terms. 

Governing Law and Venue:  These Membership Terms are construed in accordance with the laws of the Commonwealth of Puerto Rico and Members agree and consent that jurisdiction and venue of all matters relating to these Membership Terms will be vested exclusively in the federal, state and local courts within the Commonwealth of Puerto Rico.
